Privacy policy

The short version
I only use your details for the reason you gave them to me: sending your order, replying to your message, or sending you news about my work if you've signed up. I'll never sell your data. I keep it safe and only for as long as I need it. You can ask to see, correct or delete it at any time, and I'll always respond within a month. The full policy below explains which tools I use and how.

I'm Daniel Martin, trading as Daniel Martin Artist. I'm responsible for the personal information described here.

What information I collect and why

To sell and deliver my work:

  • Your name, email, phone number, and billing and delivery addresses

  • Your order history

  • Payment information. Card payments are processed securely by Squarespace, so I never see or store your full card details. If you pay by bank transfer, I'll see the account name and reference from your payment.

To keep my website working and understand how it's used (only if you accept cookies):

  • How you use my website, which pages you visit, your device and browser, and your approximate location

  • Your IP address

To send you updates and marketing:

  • Your name and email, if you've signed up to my mailing list

  • Your marketing preferences, and records of when you gave consent

  • Your email address and basket contents if you leave checkout before completing your order (see "Reminder emails" below)

To share photos of my work in your home:

  • Photos you've sent me of my work, which I only use with your permission

To answer questions, complaints or claims:

  • Your contact details, order history, and any messages we've exchanged

Why I'm allowed to use it (lawful bases)
UK data protection law requires a "lawful basis" for using personal information. Mine are:

  • Contract – to process, deliver and support your order.

  • Legal obligation – to keep financial records for tax purposes.

  • Consent – for my mailing list, non-essential cookies, advertising, and using your photos. You can withdraw consent at any time.

  • Legitimate interests – to handle queries and complaints, and to send reminder emails about unfinished orders. I only rely on this when it doesn't unfairly affect you.

Reminder emails
If you enter your email at checkout but don't finish your order, I may send you a reminder. If you'd rather not receive these, just let me know or use the unsubscribe link.

Advertising
I advertise on Facebook and Instagram. If you accept cookies, the Meta pixel on my website helps me show my work to people who have visited it. If you've agreed to marketing, I may also share your email address with Meta in a scrambled (hashed) form. This lets me reach you, or people with similar interests, with ads. Meta can't use it to identify you for any other purpose, and you can withdraw consent at any time.

Who I share your information with
I only share what each service needs to do its job:

  • Squarespace – website hosting, online shop, payments, and email campaigns

  • Mailchimp – mailing list and newsletters

  • Meta (Facebook and Instagram) – advertising and website measurement

  • Google – website analytics (Google Analytics)

  • Delivery services – postal and courier companies, and customs authorities for international orders

  • My bank and accountancy services – to process bank transfers and keep financial records

I store records securely using reputable online services, such as email and cloud storage.

Sending information outside the UK
Some of these services, such as Squarespace, Mailchimp, Meta and Google, are based in or process data in the US. When your data leaves the UK, it's protected by UK government adequacy regulations (including the UK-US data bridge) or approved contractual safeguards. For international orders, I have to share your name and address with carriers and customs in the destination country to deliver your order.

Cookies
My website uses essential cookies to work, plus analytics and advertising cookies (Google Analytics and the Meta pixel) if you accept them. You can change your choice at any time using the cookie settings on my website.

How long I keep information

  • Orders and financial records: 6 years, as HMRC requires

  • Enquiries that don't lead to an order: 12 months after we last spoke

  • Mailing list: until you unsubscribe

  • Your photos: until you withdraw your permission. I'll then remove them from my website and future posts, and delete them from my own social media posts where I can.

Your rights
You have the right to:

  • ask for a copy of your information

  • ask me to correct it

  • ask me to delete it

  • ask me to limit how I use it

  • object to how I use it

  • ask me to transfer it to you or someone else

  • withdraw consent at any time

Some rights only apply in certain situations. For example, I can't delete order records I have to keep for tax purposes. To make a request, email me. I'll respond without undue delay, and within one month at most. You can find out more about your rights on the ICO's website.
